Texas dental board takes up rules tying every license to proof of work authorization

The Texas State Board of Dental Examiners moves Friday on rules that would make every dentist, hygienist, dental assistant and dental lab in the state document that it is legally allowed to work here before a license is issued or renewed.

The board describes the package itself, on its own proposed rules page: six rules that “will require applicants to submit appropriate documentation verifying legal presence and work authorization.” Three of them — dental faculty licensure, hygiene faculty licensure and dental lab registration — were published in the spring and come back Friday for adoption. The general qualification rules covering dentists, hygienists and assistants are earlier in the pipeline, back before the licensing committee as staff drafts. Every one is published in Spanish alongside English. The board has not published an estimate of how many license holders would have to produce new paperwork.

A quieter fight runs alongside it, over who is allowed to do what. The board takes up whether dental assistants may paint on silver diamine fluoride — a liquid that stops a cavity without drilling, cheap and central to children’s dentistry — and whether they may apply Curodont, a brush-on product marketed as repairing early enamel damage. It also considers whether a dentist may run skin patch tests to find out if a filling or crown is causing an allergic reaction, conventionally a dermatologist’s job. Current rules let a dentist hand an assistant only procedures that can be undone, and no Texas rule names either product. Hygienists, by contrast, already have express authority to apply drugs to tooth surfaces.

Everything else gets a clause. A rewrite of the patient-abandonment rule would let a dentist stop treating a patient whose conduct raises a safety concern for staff, with thirty days’ notice and documentation — its third straight meeting. Three contested cases return from the state’s administrative court, all at the default or summary stage, with no findings made against anyone. Three chapters of housekeeping rules are up for readoption. And the board will take up a new Federation of State Medical Boards report on corporate influence over clinical decisions, elect a secretary, and review the executive director in closed session.

Watch the licensing committee. Whether the general-qualification drafts get sent to the Texas Register on Friday determines whether the work-authorization requirement reaches ordinary dentists and assistants this year or next.
