Texas attorney general announces investigation into Lululemon over potential toxic chemicals

Attorney General Ken Paxton announced the launch of an investigation into Lululemon USA Inc. regarding the possible presence of toxic “forever chemicals” in its activewear products.

Paxton issued a Civil Investigative Demand to Lululemon as part of a probe into whether the company has misled consumers about the safety, quality, and health impacts of its products. The investigation will focus on whether Lululemon’s athletic apparel contains per- and polyfluoroalkyl substances (PFAS), also known as “forever chemicals,” which may be associated with endocrine disruption, infertility, cancer, and other health issues.

The Office of the Attorney General will also review Lululemon’s Restricted Substances List, testing protocols, and supply chain practices to determine if the company’s products comply with its said safety standards.

“Americans should not have to worry if they are being deceived when trying to make healthy choices for themselves and their families. I will not allow any corporation to sell harmful, toxic materials to consumers at a premium price under the guise of wellness and sustainability. If Lululemon has violated Texas law, it will be held accountable,” said Paxton.

In a statement to the Associated Press, representatives of Lululemon, Inc said, “The health and safety of our guests is paramount, and our products meet or exceed global regulatory, safety, and quality standards. We require all our vendors to regularly conduct testing for restricted substances, including PFAS, by credible third-party agencies to confirm ongoing compliance.”

According to the official website, the Attorney General of Texas operates through 117 offices across the state to support its various divisions. The office includes more than 4,000 employees across 38 divisions and 117 offices, with about 750 attorneys managing over 30,000 cases each year. The Attorney General works to uphold state laws, offer legal support to government entities and defend residents through enforcement of consumer protections and other public interests. Services provided include legal counsel for the state, child support enforcement and consumer fraud prevention. The office coordinates efforts among divisions like child support and consumer protection to handle legal and public service tasks.
