Bottom line

Bottom line

This version authorizes preferred provider and exclusive provider benefit plans to pay primary care physicians and groups through fee-for-service, risk-sharing or capitation contracts, and provides that those physicians are not engaging in the business of insurance. It bars insurers from discriminating against physicians who opt out, prescribes contract terms, excludes global capitation and prohibits subcontracting. The ratings point both ways. The strongest is +1 Moderate on scope of practice and market competition, with +1 Small on judicial predictability and +1 Small on liability exposure. On the other side are -1 Small on barriers to new firm formation (the subcontracting ban) and -1 Small on new compliance requirements (the prescribed terms).
